During a Divorce that is being contested, the equitable distribution of marital property and assets may extremely complex and highly disputed. We have all heard of a 50-50% split in a divorce. The state of Florida, however, is an “Equitable Distribution” state. This means that when dividing marital property and assets for a divorce, the division and distribution of marital assets and property generally involves property and assets that were obtained during a marriage.
Of the property and assets acquired during the marriage, then a 50-50 split is generally considered. In an Uncontested Divorce, the Division of marital property and assets is much easier. Both parties have already agreed to amicably work out the details of equitable distribution and present their agreement to the court for approval.
