A Family Law Contempt Proceeding is a hearing to determine if standing family law court orders are not being adhered to by one or both parties.
Family Law Contempt Proceedings commonly involve issues such as:
Non-compliance of a standing family law court order may result in a court-ordered modification of the parenting plan (child custody, visitation, and/or child support), court-ordered wage garnishments, or temporary or permanent suspension of parental rights. In more severe cases, the individual violating the court order may face criminal charges as well.
It is important to note, that if the parent that is ordered to pay child support is behind on paying child support, or is not paying child support, the primary residential parent cannot take it upon his or herself to deny visitation or contact with his or her children. This would also be a violation of the Parenting Plan. Only the family law court can suspend or terminate visitation child visitation rights.
